if someone sells a used game to a third party the seller no longer has the game (unless they made an illegal copy of it). So there is only one copy of the software changing hands, for which the copyright holder has already been paid. The difference between this and piracy is that the pirate bought at most one copy of the software and is making multiple copies to sell, thus violating the EULA (and not paying the royalties due to the owner of the rights). |
