Ubisoft changed a few files when they bought the game from NWC. I think a few of the files in ART.rez were modified to reflect their ownership, but (more importantly) they also used an earlier version of one of the files (an EXE or DLL, I forget which) than the one NWC released. But Ubi was never interested in the M&M RPGs, so they sold the marketing rights to GOG. The result is that the 1.3 patch won't install properly on the Ubi version. That might be the source of your problem.
