directX should prevent the game from playing. What happens with that is that the install program doesn't recognize the version you have (probably 'cause it's a higher level than is required) so it fails it. But if you do have a higher level, for example the game wants DXv.8.1 and you have DXv.9.0c, it should still work, because for the most part the higher versions still work for a lot of the older stuff. So you should just ignore that and try to play it anyway, however, if the game truly won't play, you might have other problems as well. A good place to start is by downloading and installing Mok's patch. Unfortunately I can't supply the link but I'm sure somebody else can.
